1st ARC, Commissions and NCRWC

  • 1st ARC
    • Appointment of persons having long experience in public life in administration and nonpartisan attitude as governors
    • Delegation of powers to the maximum extent to the states

  • Rajamannar committee-
    • Finance commission should be made a permanent body

  • Sarkaria commission
    • Over centralisation leads to BP at the Centre and anaemia at the periphery
    • Article 356 should be used very sparingly, in extreme cases as a last resort when all other alternative screen
    • The institution of all India services should be further strengthened and some more such services should be created
    • When the President withhold his assent the the state bills, the reasons should be communicated to the state government
    • The Centre should consult the states before making a law on the subject of the concurrent list
    • On governor-
      • The governors term of five years in the state should not be disturbed except for some extremely compelling reasons
      • Governor should be a detached figure and not to intimately connected with the local politics of the state

  • Punchi commission
    • Greater flexibility to states in matters of state and concurrent list is the key to good centre-state relations
    • The exercise of discretionary powers by the government should be limited in nature and must be guided by good faith
    • Provides a clear SOP for the Governor to select a chief minister in case no party or pre-poll coalition has a clear majority
    • Governor must not remove a chief minister unless he has failed to prove his majority on the floor of the house
    • Zonal councils should meet at least twice a year
    • New all India services in sectors like health, education, engineering and judiciary should be created
    • The scope of the devolution of powers to local bodies to act as institutions of self government should be constitutionally defined through appropriate amendments

  • NCRWC-
    • Scope of fundamental rights to be expanded to include right against torture, right to compensation if a person is illegally deprived of his right to life and liberty
    • A new DPSP and control of population should be added
    • An interfaith commission should be established to promote inter-religious harmony and social solidarity
    • Fundamental duties must be expanded to include duty to go to elections, to pay taxes, etc
    • System of constructive vote of no confidence as happens in Germany
    • Lateral entry into government jobs above joint secretary level should be allowed
    • When the state bill is reserved for consideration of the President there should be a time limit within which the president should take a decision whether to give his assent or to return the bill
    • Retirement age of judges of High Court and Supreme Court should be increased to 65 & 68 respectively
    • Citizens charter must clearly highlight the entitlements of citizens belonging to SC, ST and other depressed classes
    • 73rd and 74th AA must be amended and Devolution of powers to PRI and ULB must be explicitly mentioned
    • Election commission of India should have the power to issue directions to the state election commission for the discharge of its functions
    • Any person convicted for any Heinous crime like murder, rape, smuggling etc should be permanently debarred from contesting from any political office- NCRWC
    • Criminal cases against politicians must be disposed of speedily
    • Special benches be constituted by the High Court and Supreme Court exclusively for the disposal of election petitions and election disputes
    • The model code of conduct should be given legal status and its violation should attract penal action

There are two reasons to it.  Firstly, since I had reached the interview stage in all my three attempts, I never had the luxury of time to refer to any book.  Secondly, I believe Ma'am's notes are more than enough to form the core aspect of the subject's preparation.
